Client’s family gets $118,990 Death Insurance cover after tragic loss

Mr Patel, an A-grade student came to Australia in 2016 to pursue further studies. He was the only son and his parents who lived overseas had high hopes for him having sold all their assets to fund his education in Australia. However, in or around November 2018, while Mr Patel was returning from his University, an oncoming truck crashed into his car. Unfortunately, Mr Patel passed away immediately. Given that Mr. Patel was employed part-time at a convenience store, we immediately realised that there could be a potential Death Insurance Cover within Mr. Patel’s superannuation.

We were able to reach Mr. Patel’s family overseas and they gave us authority to act of his behalf and pursue this claim. We then contacted Mr Patel’s employer and obtained his superannuation details after which we contacted his insurance provider.

After thorough investigation, we discovered that Mr Patel did have death insurance cover.

Our experienced compensation lawyers then reviewed the fine details of the insurance policy and ensured that Mr Patel was eligible for Death Insurance cover. The eligibility criteria for death insurance was strict due to Mr Patel only working part time. Nonetheless, we did not give up. We pursued the case and submitted our counter arguments, submissions, and evidence to ensure that Mr Patel meets the eligibility criteria.

After 2 months of going back and forth, the insurer finally accepted the death claim worth $118,990.

What a relief!

We contacted his parents and gave them the news of the successful claim outcome and told them we will post their cheque to them.  It was such an emotional moment. There was complete silence on the other end of the phone for 10 seconds before we heard his father break down crying. He knew the pain of losing his son would never go away, but they were trying to heal knowing that their son was in a better place. Having the Insurance Cover was a big help as it allowed the parents to pay back their loans.

It was a bittersweet and emotional moment. We knew that losing a loved one would never be easy, but we were proud to be able to help his family win this case.
