In or around 2018, our 54 year old female client fell down at a friend’s house and injured her right hand, shoulder and wrist. The injury occurred due to not ensuring the premises was safe. She initially attempted to take matters into her own hands and directly made a claim against the home Insurer. She worked in a managerial role for NSW Government and used her right hand for work. As a result of this injury, she was unable to use the computer or type which were paramount to her role. Not only did the injury prevent her from performing her work duties, it also limited her ability to look after her family as she could only perform limited domestic tasks.
Initially, the client didn’t see a need for a lawyer, so she contacted the Insurer about the sustained injury, however they failed to recognize the severity of the injury and the impact it had on her daily life. They refused to accept her medical reports and sent her to other doctors and specialists for further reports. These alternative specialist reports which were requested by the insurer’s medical professionals came with a result that was in the favour of the insurer. Our client was feeling helpless about the situation and losing all hope that she could win this. She felt that the big insurers would never see her side of the story.

We then made submissions to the insurer dissecting their provided medical records and explained why the reports provided earlier by our client were more relevant. The insurer still argued their reports were correct.

We then had a long intensive informal settlement conference where we were able to get our client a good outcome ; $110,000 as her settlement amount.
